The Services include virtual/in-person pet behavioral consultations, nutritional guidance, health-related advice, custom care plans, and related resources. Additional terms for specific Services (e.g., subscription-based consulting packages) are incorporated herein and will control if inconsistent with these Terms.
BY ACCESSING OR USING THE SITE/ SERVICES, YOU REPRESENT AND WARRANT THAT YOU HAVE THE RIGHT, AUTHORITY, AND CAPACITY TO ENTER THESE TERMS AND ABIDE BY ALL REQUIREMENTS HEREIN. YOU MAY NOT ACCESS OR USE THE SITE/SERVICES OR ACCEPT THESE TERMS UNLESS YOU ARE AT LEAST 18 YEARS OLD.

ARBITRATION NOTICE: THESE TERMS CONTAIN A BINDING ARBITRATION CLAUSE. YOU AND JOYTREE AGREE THAT DISPUTES BETWEEN US WILL BE RESOLVED BY MANDATORY BINDING ARBITRATION, AND YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT, JURY TRIAL, OR CLASS-WIDE ARBITRATION.

  • Immediately notifying us of unauthorized Account use or security breaches.
You may not create an Account or book Services using false information or on behalf of another person.

Promotions

From time to time, we may offer promotions (e.g., discounted consultation packages, free pet care resources). Promotional offers:
  • May require a unique code (non-transferable, void where prohibited by law).
  • Are subject to cancellation or modification at our sole discretion, with or without notice.
  • Are limited to eligible users (e.g., new users only, as specified in the promotion).

Service Descriptions

  • We may require verification of information (e.g., pet health details) prior to confirming a consultation.
  • Service availability is subject to change without notice. We will notify you promptly of any cancelled or rescheduled Services and offer alternatives (e.g., alternative dates, full refund).

Billing Terms

  • Service Models: We offer two billing options:
    1. One-Time Bookings: Single consultations or standalone Services (e.g., a single behavioral assessment). Full payment is required upfront to confirm booking.
    2. Subscription Packages: Recurring monthly/quarterly consulting services (e.g., ongoing behavioral training support). You authorize automatic recurring payments to your selected payment method until canceled (30 days’ written notice required for cancellation).
  • Billing Description: Charges on your payment statement will appear as joytree.my.
  • Checkout Requirement: To complete a booking, you must check the mandatory checkbox stating:

Permissible Uses of the Site/Services

Subject to these Terms, we grant you a limited, non-transferable, non-exclusive license to access and use the Site/Services for personal, non-commercial purposes. This license excludes the following restricted uses:
  • Reselling, licensing, or commercially exploiting the Site/Services (e.g., using our consulting methodologies to offer competing services).
  • Modifying, reverse engineering, disassembling, or creating derivative works of the Site/App or its content.
  • Scraping, harvesting, or collecting data from the Site/Services (e.g., consultant information, pet care resources) without prior written consent.
  • Framing or embedding Site content (e.g., logos, consulting materials) without authorization.
  • Using the Site/Services for unlawful purposes or in violation of these Terms.
We may terminate this license at any time for any reason. We reserve the right to modify, suspend, or discontinue the Site/Services (or any part thereof) with or without notice, and we are not liable for any such changes.

Intellectual Property Rights

All content and materials on the Site/Services (e.g., consulting methodologies, care plans, logos, text, graphics, videos, pet care resources) are the proprietary intellectual property of Joytree or our licensors, protected by U.S. and international copyright, trademark, and other laws.
  • You may not copy, reproduce, distribute, republish, or use any intellectual property without our prior written consent.
  • Custom deliverables (e.g., personalized pet care plans) are licensed to you for personal use only—no commercial sharing or redistribution is permitted.
  • Trademarks (e.g., Joytree, joytree.my, and related logos) may not be used without our express written permission.

User Content

“User Content” means any information or materials you submit to Joytree (e.g., pet photos/videos, behavior descriptions, feedback, reviews). You are solely responsible for your User Content and warrant that:
  • You own or have the right to use the User Content.
  • The User Content does not violate third-party rights (e.g., copyright, privacy) or these Terms.
By submitting User Content, you grant Joytree an irrevocable, non-exclusive, royalty-free worldwide license to use, reproduce, distribute, and display the content for business purposes (e.g., improving Services, promotional materials) without attribution or compensation. We may delete User Content at any time and are not obligated to back it up.

Acceptable Use Policy

You agree not to use the Site/Services or submit User Content that:
  • Violates any law, regulation, or third-party rights (e.g., privacy, copyright).
  • Is harassing, abusive, defamatory, obscene, or harmful (e.g., content promoting animal cruelty).
  • Contains viruses, malware, or other harmful code.

Disclaimer of Warranties

Limitation on Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JOYTREE AND ITS AFFILIATES, EMPLOYEES, CONSULTANTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE/SERVICES (E.G., LOST TIME, PET CARE COSTS, EMOTIONAL DISTRESS).
OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE/SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow liability limitations, so this section may not apply to you.

Indemnity

You agree to indemnify and hold Joytree, its affiliates, employees, consultants, and service providers harmless from any claim, demand, or damages (including attorneys’ fees) arising from:

  • Your User Content.
  • Your violation of these Terms or applicable laws.
  • Your interaction with third parties via the Site/Services.
We reserve the right to assume exclusive defense of any matter subject to indemnification, and you agree to cooperate with our defense.

Dispute Resolution & Arbitration

EXCEPT FOR SMALL CLAIMS COURT CLAIMS, YOU AND JOYTREE AGREE TO RESOLVE ALL DISPUTES (INCLUDING THOSE RELATED TO THESE TERMS, PRIVACY POLICY, OR SERVICES) VIA BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) UNDER ITS CONSUMER ARBITRATION RULES.
  • Pre-Arbitration Notice: You must provide 60 days’ written notice of the dispute (via email to career@joytree.my) and attempt to resolve it amicably before initiating arbitration.
  • Class Action Waiver: Disputes shall be resolved individually—you waive the right to participate in class actions or representative arbitrations.
  • Governing Law: The Federal Arbitration Act and the laws of the State of Connecticut govern this section.
  • Arbitration Location: At your election, arbitration shall take place in the county of your residence, via telephone, video conference, or written submissions.
If any arbitration provision is unenforceable, the remaining terms shall apply. For disputes not subject to arbitration, exclusive jurisdiction lies with the courts of New Haven County, Connecticut.

Term & Termination

These Terms remain in effect while you use the Site/Services. We may suspend or terminate your Account/Services access at any time, for any reason, without notice (e.g., violation of these Terms, suspected abuse).
Upon termination:
  • Your Account and access to the Site/Services will end immediately.
  • You must cease using Joytree’s intellectual property.
  • Terms related to intellectual property, indemnity, liability limitations, and dispute resolution will survive termination.

Digital Millennium Copyright Act (DMCA)

We respect copyright laws. If you believe your work is infringed on the Site, submit a written DMCA notice to our Copyright Agent with:
  • Your signature (physical or electronic).
  • Identification of the copyrighted work.
  • Identification and location of the infringing material.
  • Your contact information (address, phone, email).
  • A statement of good faith belief that use is unauthorized.
  • A statement (under penalty of perjury) that the notice is accurate and you are authorized to act on the copyright owner’s behalf.
